Class Action Lawsuits Defined

A class action is a civil lawsuit filed by multiple people who experienced the same injury from the same product, a single trial to hear all claims. Moving Past Depression

We all feel sad at times. We get lonely when someone we love ignores us. We feel disappointed when we fail at something. And we may lose something that we value. At times, our sense of loss is enormous, and we feel grief.

Depression, however, can also become a pervasive mood that slowly destroys our lives. It erodes our health and well-being, diminishes our self-esteem, and destroys our relationships.

While chronic depression is a clinical problem, requiring professional intervention, there are a few practical things we can do to snap out of feeling blue. Thus, although pervasive feelings of despair are due to past trauma, it is possible to take care of reactive depression that arises from circumstances by taking some practical measures.

Exposure to Light:

A common form of depression arises from deprivation of light and sunshine. This has been called S.A.D. or Seasonal Affective Disorder.

Insufficient exposure to sunshine triggers the secretion of a hormone called melatonin. When this is low in our bodies, we feel lethargic and uninterested in anything.

Since the nights are longer in winter than in summer, more melatonin tends to be secreted. This lowers our body temperature and makes us feel sluggish.

Simple remedies include lighting up the room better, especially with light bulbs that simulate natural light, walking more outdoors during the day, and spending more time exercising.

Inspiration:

Busy people are often inspired people, and they are less likely to feel depressed. Doing what you love, taking inspired action, and associating with lively people is a sure-fire way to overcome feeling down.

Passionate action arises from creating goals. Intentions give meaning to our lives. As we act on them, we develop an unshakable belief in our own self worth. A positive attitude emerges from meeting and overcoming challenges.

Recuperation:

Occasionally, fatigue causes a drop in our mood levels. When we are stressed, our minds become frantic and our bodies get exhausted. Taking hot baths, getting a massage, or just doing something fun can rapidly shift our moods.

Diet:

Eating right can improve our mood. While caffeine and sugar may give you a temporary energy spike, they also stimulate anxiety. And while alcohol may be considered a way to forget problems, it is actually a depressant.

Socializing:

Finally, a lot of depression is simply due to isolating ourselves. Many jobs are object-related with little social interactions. With a warm circle of friends, we tend to view life in a more optimistic way.

Besides, the possibility of partaking in social engagements, words of encouragement, timely advice, moments of camaraderie and high humor can do wonders to lift our spirits.

Intimacy:

Finally, of course, intimacy is the highest form of friendship, where the power of touch has a way of soothing and relaxing us. Experiencing respect and care is essential to being human. Love is the ultimate cure for depression.

When’s Sarah Coming Home? Helping Your Child Understand Death

For most children, their first experience with grief comes with the death of a beloved family pet. When Zoe the eight-week old puppy dies of parvovirus or Tweety the budgie stops singing his morning song, a child experiences profound and lasting loss for the first time in their young lives.

Children want and need to know about death, yet we are often reluctant even squeamish when talking about it. Conversations with kids about death can be extremely difficult, but they are so important. Helping children understand the death of their pet may arm them with the skills they need to cope and grieve effectively when someone they love dies.
Everyone experiences a sense of shock when death occurs, and this is especially true for children. They have no prior experience, and usually no information to help them comprehend what “dead forever” means.

Death and grief are extremely difficult human emotions, therefore, there is no right or wrong way to deal with death. As adults, our reactions to death are a product of societal attitudes and the beliefs and culture of the family from which we came.

When a family member dies, children express their grief differently depending on their age. An infant may become irritable and fussy. A pre-schooler lives in a magical world, so death isn’t permanent for them. They may alternate between seeing death as temporary and reversible to understanding that death is forever. Children ages six to 12 have a more mature understanding of death and teenagers have an adult understanding of death, but has fewer coping skills.

Let’s look at Justin’s first experience with death:

Justin’s is 5 years old and lives with his mom and dad and brand new sister Sarah. One morning, Justin wakes up to mom’s tears and runs to Sarah’s room to find mommy and daddy crying. Daddy ushers Justin out of the room and tells him quietly that Sarah isn’t going to wake up today.

Justin is scared and confused. Justin has never seen Daddy cry. Dad is his hero. He makes Justin feel safe. What could be so horrible that it would make Daddy cry? Daddy spends the morning talking to Justin while mom and Grandma Jane go in and out of the house, crying and Sarah is taken away by strange people that Justin does not know.

After lunch, Justin goes to Sarah’s room to look for her. They always take an afternoon nap together. But Sarah isn’t there. “When will Sarah be home?” Justin asks his daddy. Daddy holds Justin as he tells him “Sarah won’t be coming home, honey, Sarah has died. She stopped breathing and her heart stopped beating. We’re all so very sad. Why don’t we sit together and remember some of the funny things she used to do.” Justin turns his blue eyes to look at Daddy “No, it’s okay Daddy. She’ll be home later.”

As the days go on from the time of Sarah’s death, mom and dad are caught up in funeral preparations and Justin continues in his insistence that his sister will come home. As family gathers and the days get closer to the services his parents remain with growing concern for his belief.

Parents should be aware of normal childhood responses to a death in the family. It is normal during the weeks following the death for some children to feel immediate grief or persist in the belief that the family member is still alive. But long-term denial of the death or avoidance of grief is unhealthy and can later surface in more severe problems.

Once children accept the death, they are likely to display their feelings of sadness on and off over a long period of time, and often at unexpected moments. The surviving relatives should spend as much time as possible with the child, making it clear that the child has permission to show his or her feelings openly or freely.

Parents with children experiencing grief should:

  • Provide age-appropriate information regarding the loss
  • Give the child space for them to emote. (Encouragement to discuss his or her innermost fantasies, fears, thoughts, and feelings.)
  • Be aware of their own emotional availability: Your child needs someone who will listen. Reach our for support from others if you are unable to provide that support to your child at this time.

Warning signs include:

  • changes in sleep, appetite, school performance, or social interaction
  • verbal/non-verbal messages of wanting to join the deceased (drawings, behaviors, or statements)

Keep In Mind: Children need to be assured that death is not the endthat love never dies. Just because the person is no longer living, doesn’t mean we don’t still love them. You are the expert of your child and always reach for assistance from a professional if you have any questions.

Prologue and Rationale

Depression is an illness that involves body, mind and thoughts. It is not a physical weakness that will vanish within days but it’s the state that interferes with the daily chores of life resulting in poor performance or output. It gives rise to a negative feeling for each and every thing. It may also be defined as allergy, which triggers an unhappy reaction. The patient must gain control over his nervous system and channelise the mental and emotional activities into harmonious vibrations. This can only be achieved by taking good amount of sleep and rest. Meditation is also the best technique in treating chronic depressions. It will help to create an amount of balance in the nervous system.

ISP Rejects Diebold Copyright Claims Against News Website

EFF Defends Right to Publish Links to Electronic Voting Memos

San Francisco - Defending the right to link to controversial information about flaws in electronic voting systems, EFF announced today it will defend an Internet Service Provider (ISP) and a news website publisher against claims of indirect copyright infringement from the electronic voting machines’ manufacturer.

On October 10, 2003, electronic voting company Diebold, Inc., sent a cease-and-desist letter to the nonprofit Online Policy Group (OPG) ISP demanding that OPG remove a page of links published on an Independent Media Center (IndyMedia) website located on a computer server hosted by OPG.

Diebold sent out dozens of similar notices to ISPs hosting IndyMedia and other websites linking to or publishing copies of Diebold internal memos. OPG is the only ISP so far to resist the takedown demand from Diebold.

“What topic could be more important to our democracy than discussions about the mechanics and legitimacy of electronic voting systems now being introduced nationwide?” said EFF Staff Attorney Wendy Seltzer. “EFF won’t stand by as corporations like Diebold chill important online debate by churning out legal notices to ISPs that usually just take down legitimate content rather than face the legal risk.”

The Digital Millennium Copyright Act (DMCA) passed by Congress in 1998 provides a “safe harbor” as an incentive for ISPs to take down user-posted content when they receive cease-and-desist letters such as the ones sent by Diebold. By removing the content, or forcing the user to do so, for a minimum of 10 days, an ISP can take itself out of the middle of any copyright claim. As a result, few ISPs have tested whether they would face any liability for such user activity in the first place. EFF has been exposing some of the ways the safe harbor limits online speech through the Chilling Effects Clearinghouse.

“We defend strongly the free speech right of our client IndyMedia to publish links to Diebold memos relevant to the public debate about electronic voting machine security,” explained OPG Executive Director Will Doherty. “Diebold’s claim of copyright infringement from linking to information posted elsewhere on the Web is ridiculous, and even more silly is the claim that we as an ISP could be liable for our client’s web links.”
